ROOTS Subscription
National Trust for Scotland Enterprises Ltd is a limited company incorporated in Scotland (Registered Number : SC095585) and having its registered office at Hermiston Quay, 5 Cultins Road, Edinburgh, EH11 4DF. It is a wholly owned subsidiary of The National Trust for Scotland, a charity registered in Scotland (registered number: SC007410) and having its principal office at Hermiston Quay, 5 Cultins Road, Edinburgh EH11 4DF. All of the profits of National Trust for Scotland Enterprises Ltd are donated to the National Trust for Scotland.
On subscribing to ROOTS you are automatically agreeing to these terms and conditions and you are providing us with the appropriate consent to handle your personal information in accordance with data protection laws and our data protection policies. References to the “Trust”, “we” or “us” are references to the National Trust for Scotland Enterprises Ltd.
Our acceptance of your subscription will bring into force a legally binding contract between us and these terms and conditions will form the basis of that contract through which the Trust will deliver goods and services to you as a Subscriber. Where you apply for Gift subscription for someone else, we will deliver these goods and services to the person named in your application.
The National Trust for Scotland cannot be held liable if your seeds do not grow.
ROOTS benefits
As a subscriber you will automatically receive a range of benefits as part of your subscription. The minimum package will include:
- 10 ROOTS packs a year, sent every six weeks
- 10 ROOTS emails a year sent every six weeks
- Invitations to two ROOTS events a year
Subscriptions made by Direct Debit are ongoing with no termination date unless you cancel. Subscriptions bought up front by credit/debit card for the Subscriber or as a Gift will last for 12 months and we will be in touch to seek renewal.
We reserve the right to change the benefits that apply to ROOTS without prior notice. However, where possible, changes to benefits will be emailed to you in advance and published on our website. If the benefits to be provided are not material similar to those set out above you may cancel your subscription.
Right to refuse subscriptions to ROOTS
The Trust reserves the right to refuse any subscription for ROOTS. The Trust also reserves the right not to fulfil or to cancel a subscription if you (or the subscriber, where you purchase Gift subscription for another person) are found to be in breach of these conditions and/or default on payment.
On receipt of your subscription, we will debit your card or process the Direct Debit payment for the price (as applicable). However, our acceptance of your subscription remains subject to approval of it. If we choose not to accept your subscription we will let you know and refund any monies taken for the subscription, where cost has not been occurred for fulfilment.
If we are unable to obtain payment authorisation from the issuer of your card or from your bank in the case of Direct Debit payments and a subscription has already been issued to you, we will request the payment of any packs you have received using another method of payment.
ROOTS Price information
We reserve the right to increase the price of your ROOTS subscription on an annual basis. You will be informed of any subscription increase within your renewal letter or by letter should you pay by direct debit.
Credit/Debit card payments for ROOTS
The credit/debit card information you provide us for a subscription transaction is used solely for the purpose of processing that subscription transaction. If we are unable to process payment from the credit/debit card details you have provided we will contact you immediately to verify your card details.
We strongly advise you against sending us any credit/debit card information via email. It is contrary to the rules of the Payment Card Industry (PCI) for us to accept credit/debit card payments by email and we will decline to accept payment by this means.
If you are not using your own credit/debit card to pay for your ROOTS subscription, you must ask permission of the credit/debit card holder before entering payment details. When you subscribe to ROOTS either online, by post or verbally, you are confirming that you have obtained the express prior permission of the credit/debit card holder.
Direct Debit payments
If there are any changes to the amount, date or frequency of your Direct Debit, the Trust will notify you 10 working days in advance of your account being debited or as otherwise agreed. If we request to collect a payment, confirmation of the amount and date will be given to you at the time of the request.
If an error has been made in the payment of your Direct Debit by us or your bank/building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society. If you receive a refund you are not entitled to, you must pay it back when requested to do so by the Trust.
You can cancel a Direct Debit by contacting your bank or building society. Written confirmation may be required. However, cancellation of your direct debit is not the same as cancellation of your subscription, which may require notice to be given to us. Please see Section 6 below. If you cancel or choose not to renew your subscription you must also notify us using the method set out in that section
Your rights to cancel
As a consumer, you have a legal right to cancel the contract formed between us (and receive a refund of the fees paid) within 14 days if you change your mind or decide for any other reason that you do not want to continue the subscription.
Your legal right to cancel the contract starts from the date on which we confirm that your ROOTS subscription has been accepted or from renewal, which is when the contract between us is formed. If you paid by credit/debit card, your deadline for cancelling the contract is 14 days after the day on which this contract was formed. To cancel a contract in this way, you need to let us know that you have decided to cancel. Please see section 7 below to find out how to notify us.
If you cancel the contract in accordance with above, we will refund you the price you paid for ROOTS. Please note we are permitted by law to reduce your refund to reflect the period of time (if any) that the subscription was valid up to the date on which we were notified of your decision to cancel the contract; and make any refunds due to you as soon as possible.
ROOTS subscription by Direct Debit is ongoing until cancelled
If you pay for your ROOTS subscription in full in advance, then you can choose to cancel but may not receive any refund. We shall only refund on exceptional circumstances.
Subscription rights and benefits shall cease on death and a refund will not be given.

Gift Subscription of ROOTS
Gift subscription can only be used by the named beneficiary (subject always to the terms of the subscription purchased).
The purchaser of any Gift subscription warrants that he/she has the consent to provide the recipients personal data to the Trust for the purposes of administering the ROOTS subscription and it’s benefits.
Data protection and use of personal data
When you apply for ROOTS subscription (and throughout the course of your subscription) it will be necessary for us to obtain certain information from you (such as your name, address and email address). We will treat this as personal data for the purposes of data protection law. The Trust will collect, hold and process your personal data in accordance with our Privacy Policy.
Liability
The Trust excludes all liability to ROOTS Subscribers or to any other third party for any loss of profit, or any special, incidental or consequential damages (however arising, including negligence) arising out of, or in connection with services, benefits and/or products supplied by the Trust or any company associated with the Trust. If any deliveries are faulty then please notify us on the contact details below.
Nothing in these terms and conditions excludes liability for death or personal injury caused by the Trust’s negligence or for fraud or fraudulent misrepresentation.
Queries, comments and complaints

Anything said by any member of our staff on our behalf should not be understood as a variation of these terms and conditions, nor as a representation about the nature and quality of the services being offered by us.
